INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in December 2017. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in December 2017. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of December 2017 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Canada Labour Code : S.C. 2017, c. 20 various sections in force 03/12/17 making amendments to increase the maximum length of parental leave to 63 weeks, extend the period prior to the estimated date of birth when the maternity leave may begin to 13 weeks, create a leave for a family member to care for a critically ill adult and allow for the leave related to the critical illness of a child to be taken by a family member.

Highway Traffic Act : S.M. 2017, c. 22, Part 3 came into force 01/12/17 adding "cannabis" to Section 1 Definitions; adding Section 213.1 Transporting cannabis in or on vehicles, and Section 213.2 Consuming cannabis in vehicles; adding subsection (2.1) under Section 265 Screening device test: request to surrender licence, and adding subsection (1.1) under Section 273 Registrar's power to cancel or suspend; plus various other amendments.

Noxious Weeds Act : S.M. 2015, c. 38, s. 6 came into force 31/12/17 replacing Section 5 Duty respecting farm machines with a new Section 5 Prohibition on moving certain items.

Off-Road Vehicles Act : S.M. 2017, c. 22, Part 6 came into force 01/12/17 adding "cannabis" to Section 1 Definitions. Also adds two new sections: Section 31.2 Transporting cannabis in or on off-road vehicles, and Section 31. 3 Consumption of cannabis in or on off-road vehicles.

Low Carbon Transportation Fuels in Ontario: Amendments to Ethanol in Gasoline (O. Reg. 535/05) and Greener Diesel - Renewable Fuel Content Requirements for Petroleum Diesel Fuel (O. Reg. 97/14) Regulations

The Ministry is proposing to amend the Ethanol in Gasoline and Greener Diesel regulations to create an incentive for emerging renewable fuel technologies, require gasoline suppliers to maintain an average of at least 10% ethanol in regular grade gasoline (88 octane or less), by volume per calendar year and require ethanol used for compliance to emit significantly fewer (e.g. 35%) greenhouse gas (GHG) emissions on a lifecycle basis than petroleum gasoline starting in 2020.

Duncan, for failing as an employer to take every precaution reasonable in the circumstances for the protection of a worker contrary to section 25(2)(h) of the Occupational Health and Safety Act (OHSA). Gordon Graham, $15,000 on October 30, 2017 before a judge, Justice Paul T. O'Marra, for failing as a supervisor to take the reasonable precaution of immediately insisting that a crane be taken out of service after being advised by its operator that it was in a state of disrepair and was a serious danger to himself and workers, contrary to section 27(1)(c) of the OHSA. Andry Sokhan, $13,000 on on November 8, 2017 before a judge, Justice Nancy S. Kastner, for failing as a worker to work in compliance with section 93(2)(a) of the Construction Projects Regulation (Regulation 213/91): "no vehicle, machine, tool or equipment shall be used while it is defective or hazardous," contrary to section 28(1)(a) of the OHSA. Crown Counsel: Joe Ferraro. The court also imposed 25-per-cent victim fine surcharges as required by the Provincial Offences Act. Toromont Industries Ltd., 3131 Highway 7 West, Concord, Ontario, contracted with J.M.R. Electric for a portion of the electrical work and the employer of the injured worker. October 27, 2017Bondfield Construction was convicted on two counts and fined $175,000. J.M.R. Electric was convicted on two counts and fined $75,000.
